Steve Madden sues eBay

stevemadden-ebaySteve Madden have filed a law suit against eBay alleging that the online auction website sells counterfeit watches on their website. The lawsuit, filed with the US District Court in Manhattan, claims that unlicensed watches bearing the Steven Madden brand name were sold on eBay and that eBay ignored their cease and desist letter and request to remove the counterfeit watches. They join the likes of Hermes, LVMH and Tiffany & Co to file similar suits against the online auctions website. [Reuters]

    I hope they are successful. Ebay can’t just shrug it’s shoulders while facilitating trademark and copyright infringement. By profiting from these listings of fakes they should be treated as co-accused!

    I think eBay’s position on this subject previously has been that users selling counterfeit goods get bad feedback scores, and after a few sales they are no longer able to attract customers, so the eBay community is self-policing. However, that assumes people buying on the site do not want counterfeit goods, which is a tall assumption when so many people in the world are unabashed posers.
